DRIVE ABOUT CAR RENTAL AGREEMENT
Terms of Service
This Car Rental Agreement is entered into between Drive About Car Rental “Owner” and Renter defined as both
the “Name”/ “Signer” (collectively the “Parties”) and outlines the respective rights and
obligations of the Parties relating to the rental of a car.
Rental term
The term of this Car Rental Agreement is for the date of vehicle pickup (as indicated on the
reservation) until the return of the vehicle to Owner no later than 5pm on the same date (or if
extended, as indicated on the reservation, by 5pm) and completion of all terms of this agreement by
both Parties.
Scope of use
Renter will use the Rented Vehicle only for personal or routine business use, and operate
the Rented Vehicle only on properly maintained roads and parking lots. Renter will comply with all
applicable laws relating to holding licensure to operate the vehicle, and pertaining to operation
of motor vehicles. Renter will not sublease the Rental Vehicle or use it as a vehicle for hire.
Mileage
Mileage of the Rental Vehicle is unlimited. However, the rental vehicle is restricted to the area
between Skagway and Emerald Lake, Carcross, YT. Written exceptions, signed by company management,
on company letterhead may be made in special circumstances.
Typical Fees
Renter will pay to Owner rental fees for use of the Rental Vehicle as follows:
� Base rental fee: Daily rate for rental period defined as – 12:01am-5pm, each day
� Fuel: $10 per gallon to fill tank ~ only If returned without a full tank
Other possible fees:
We Remove Your Trash- (cups, wrappers, water bottles, face masks etc.) it is expected you will
dispose of it before returning. $20
We Return Your Valuables Left Behind- Cost of priority mail to your address – we will supply the
tracking #
�Late Return- $100. The policy states ALL rentals are due by or before 5pm without exception~ We
encourage you to text us when the rental has been returned and is ready to be prepared for the next
day.
As part of this agreement, we require that you authorize Drive About Car Rental to charge the
credit card provided on the reservation when/ if applicable. A receipt will be sent at the same
time.
Insurance
The renter needs to bring insurance that would cover damage to the Rental Vehicle at the time this
Car Rental Agreement is signed, as well as personal injury to the Renter, passengers in the Rented
Vehicle, and other persons or property. If the Rental Vehicle is damaged or destroyed while it is
in the possession of Renter, Renter agrees to pay any required insurance deductible and assign all
rights to collect insurance proceeds to Owner. Insurance is to cover Renter in both USA & Canada
(if driving into Canada).
Many Credit Card Companies have some coverage available for the rental- Check with your
credit card company.
Indemnification
Renter agrees to indemnify, defend, and hold harmless the Owner for any loss, damage, or legal
actions against Owner as a result of the Renter’s operation or use of the Rented Vehicle during the
Term of this Car Rental Agreement. This includes any attorney fees necessarily incurred for these
purposes. Renter will also pay for any towing fees, parking tickets, moving violations, roadside
assistance (if due to the Renter’s error or misuse of vehicle), or other citations received while
in possession of the Rented Vehicle.
Representations and warranties
Owner represents and warrants that to Owner’s knowledge; the Rental Vehicle is in good condition
and is safe for ordinary operation of the vehicle.
Renter represents and warrants that Renter is legally entitled to operate a motor vehicle under the
laws of this jurisdiction (Alaska & Canada) and will not operate it in violation of any laws, or in
any negligent or illegal manner. Renter has been given an opportunity to examine the Rental Vehicle
in advance of taking possession of it, and upon such inspection, is not aware of any damage
existing to the vehicle. The exception is: minor scratches & dings (including windshield ”dings”
due to road gravel) which would be considered normal wear and tear for the environment. Vehicle
interior is intact without rips or broken parts.
Please alert us before taking the vehicle, if any abnormal conditions are noticed at pick up.
Jurisdiction and venue
This agreement is legal and binding between Parties as stated above. The Parties each represent
that they have authority to enter into the agreement.
In the event of any dispute over this agreement, this Car Rental Agreement will be interpreted by
the laws of the State of Alaska, and any lawsuit or arbitration must be brought in the
corresponding region of Southeast Alaska. If any portion of this agreement is found to be
unenforceable by a court of competent jurisdiction, the remainder of the agreement would still have
full force and effect.
Entire Agreement
This Car Rental Agreement constitutes the entire agreement between the Parties in connection with
the subject matter hereof. No modification to this agreement shall be valid or made unless in
writing signed by company management on company letterhead. Changes signed by Drive About Car
Rental management on company letterhead may be made in special circumstances.
Renter must provide a copy of their Driver’s License and proof of insurance and state if they are
using a Credit Card that is providing necessary coverage If they want to have a second driver they
must provide a copy of both Driver’s license and proof of insurance at the time of reservation.
(Unless on same policy as Renter).
Be prepared to upload clear copies of the Driver license for the renter and up to 1 additional driver) to the agreement as part of reservation using the link provided on the reservation form.
