DRIVE ABOUT CAR RENTAL CONTRACT & AGREEMENT

Terms of Service

This Car Rental Contract/Agreement is entered into between the Drive About Car Rental Business owner and Renter/Cardholder (aka “Customer) defined as both the “Name”/ “Signer” (collectively the “Parties”) and outlines the respective rights and obligations of the Parties relating to the rental of a car.

Risk Acknowledgement

I understand that Drive About Car Rental does not want to reduce my enthusiasm for the activity but wants me (Renter/cardholder) and passengers to be informed in advance about the activities’ inherent risks. While Drive About Car Rental has made efforts to supply suitable rental equipment in accordance with the reservation (vehicle, child car seat, or booster seat) for driving on the S. Klondike Highway from Skagway, AK to Emerald Lake, Carcross, Yukon Territory, I, as the renter/cardholder, recognize and have informed the other passengers that this activity carries risks, some of which are inherent and cannot be completely mitigated. The same elements that help create the unique character of this activity may cause loss or damage to the rented equipment, personal items, accidental injury, permanent disability or death. The activity involves driving through remote areas where I/we will be subject to many risks involving both environmental and wildlife, as well as other motorists on the road and roadway hazards. I understand that, given the remote locations in Alaska and Canada's Yukon Territory, there is a possibility of being stranded without Wi-Fi access. Drive About Car Rental has stated that they cannot ensure a prompt return to Skagway and will not cover any costs associated with fines, fees, or rebooking necessitated by travel disruptions. In the unlikely event of being stranded, several options have been suggested to return to Skagway swiftly, with message delivery being the least efficient method. I/we may need to flag down another tourist and ask for a ride back to Skagway after securing the vehicle and taking the keys with me to return them to the business owner. I/we may need to send a message through a passer-by asking Drive About to come help us and wait. Or to flag down a tour company and ask for a ride or for a message to be delivered. I have been advised that Wi-Fi is available to the public in Carcross at the Visitor Center.

Rental term

Business hours 7am-5pm daily

  • The term of this Car Rental Agreement is always “Daily” ending at 5pm each day.

  • Pick up time any time after 7am

  • If arriving by air, Rental Vehicle is available for pick up at the arrival time of the first flight of the day

  • From April 15 - October 15(Cruise season) Rental vehicles are permitted to go into Canada, as far as Emerald Lake (Carcross, Yukon Territory)

  • Off season only Oct 16-April 14, we offer multi-day rental, for this, the rental is due back by 5pm on the last day of the rental period. Rental vehicles are not permitted into Canada and are for local use only.

Scope of use

  • Renter and any other renter designated operator of the motor vehicle must be at least 25 years of age and will use the Rented Vehicle only for personal or routine business use and operate the Rented Vehicle only on properly maintained roads and parking lots. Renter will comply with all

    applicable laws relating to holding valid licensure to operate the vehicle in the United States and Canada and pertaining to operation of motor vehicles. Renter will not sublease the Rental Vehicle or use it as a vehicle for hire (taxi or tours).

Mileage & Restrictions

  • Mileage of the Rental Vehicle is limited to 200 miles per day. The rental vehicle is restricted to the area between Skagway and Emerald Lake, Carcross, YT. (a distance of approximately 60 miles each way) The rented vehicle is

  • NOT PERMITTED TO GO TO WHITEHORSE, YT

  • Mileage in excess of 200 miles, will be charged a fee of $1 per mile-rounded up (Most renters traveling to and from Emerald Lake, Carcross and all surrounding areas of Skagway will travel 150 miles and less in a 10-hour day)

Rental Fees/Fines

Under this contract & agreement the renter/cardholder is liable for any and all fees/fines. By making a reservation and signing the rental contract & agreement the renter/cardholder authorize Drive About Car Rental to charge the credit card specified in the reservation when/if applicable. A receipt will be issued concurrently. The renter agrees to pay the owner the fee/fine for the use of the rental vehicle and fines incurred as outlined below:

  • Base rental fee: Daily Rate + Tax & Fee for rental period defined as – each day ends at 5pm.

  • $10 per gallon fine- to fill tank if returned without a full tank/underfilled- **Take a clear photo that includes both odometer and fuel gauge before you depart and once more upon your return to the parking lot.

  • $20 fine for Trash removal- (Food, liquids, tissues, diapers, cups, wrappers, cans, bottles, face masks etc.) You are expected to dispose of it before returning. A plastic trash bag is provided for your convenience with disposables. Please use a nearby trashcan if possible. If that's not an option, just fill the bag, seal it, and we'll happily dispose of the plastic bag for you at no extra cost!

  • $100 cleaning fine for SMOKING of any kind in/near the vehicle will be assessed if the odor of smoking anything is detectable and/ if ash or burns are discovered in the vehicle. In addition, smoking near the vehicle and allowing smoke to enter the vehicle will also incur a charge.

  • A $100 fine will be imposed for late returns. Our policy mandates that all rentals must be returned by 5pm, without exceptions. Please plan your schedule to accommodate this. Lastly, it is important that after returning the rental to its original pickup location, you MUST text or call or use “WhatsApp” to prevent any late fees. Your message will act as proof of the rental's prompt return and will inform us that the vehicle is ready for cleaning.

  • The Renter will be solely responsible for any fees or fines levied by authorities for violations, or charges from a tow company hired to return the vehicle to Skagway, resulting from the mishandling of the rental, trespassing on private property, or any other driver errors or violations. Furthermore, due to the remote location, the Renter may incur additional charges not covered by insurance if repairs are necessary and the vehicle must be transported to Juneau for service (e.g., broken glass from locking keys inside the vehicle)

Insurance Coverage

We don’t sell it- each driver must bring their own full coverage

By executing this Agreement and by operating the vehicle, Renter/Cardholder & optional 2nd driver assures Drive About Car Rental that while serving as driver, has bodily injury and property coverages applicable for the rented vehicle at least to the extent of $50,000/$100,000 in liability, and $25,000 for property damages to vehicle which coverage shall be first and primary to any insurance provided by Renter/Cardholder or the second driver, if driving.

The "Renter," is both the primary driver and payment cardholder. The renter, along with an optional designated second driver, must each secure comprehensive insurance coverage

  1. Authorized driver(s) must carry full coverage insurance (Liability & Collision) that covers rental cars. “Authorized driver” is defined as

    (one) Renter/cardholder and the optional (one) 2nd driver who is listed on the reservation prior to picking-up the rental vehicle. There will only be a maximum of two authorized drivers.

  2. Both the renter and (if opted) the 2nd driver need to bring insurance that would cover damage to the Rental Vehicle during the rental period

    as well as personal injury, passengers in the Rented Vehicle, and other persons or property.

  3. In the event the Rental Vehicle is damaged or destroyed while under contract with the renter, the renter is liable for any and all fees/fines incurred during the rental period and agrees to pay any applicable insurance deductible and assign as primary recipient all rights to collect insurance proceeds, to the business owner of Drive About Car Rental. The insurance must protect the renter's interests while in both the USA and Canada.

  4. Many credit card companies offer collision damage waiver (CDW) for rental vehicles. It's advisable to verify with your credit card provider and ask about what it covers. A “collision damage waiver” does not include the required liability coverage, which must be provided separately.

Indemnification

  • Indemnity: The Renter/Cardholder and an authorized second driver (If the option “second driver” is selected at the time of reservation and evidenced by the provision of their valid driver's license and proof of insurance) release and hold Drive About Car Rental harmless from any loss, injury, damage, legal actions against its owner, or claims of any kind to any person, object, or property. This release is in whole or in part due to any act or omission of the Renter/Cardholder or authorized second driver while operating the vehicle during the term of this Car Rental Agreement, or due to any breach of terms in this Agreement by the Renter/cardholder or authorized second driver. This full indemnity extends to the limits of any and all claims, settlements, payments, assessments and/or awards as well as all costs and expenses of customer’s duty for/of a legal defense, defense costs, or Drive About Car Rental costs, expenses and full attorney’s fees incurred by Drive About CarRental

Representations and warranties

  • Owner represents and warrants that to Owner’s knowledge; the Rental Vehicle is in good condition and is safe for ordinary operation of the vehicle.

  • Renter represents and warrants that Renter and one other driver shown on the reservation (if applicable), meets the age requirement of 25 years old or older, is legally entitled to operate a motor vehicle under the laws of this jurisdiction (Alaska & Canada) and will not operate it in violation of any laws, or in any negligent or illegal manner. Renter/Cardholder confirms each authorized driver on the reservation is of proper health and fitness to operate the vehicle.

  • Renter has been given an opportunity to examine the Rental Vehicle in advance of taking possession of it on the date which it is reserved at time of pick-up, and upon such inspection, is not aware of any damage existing to the vehicle. The exception is: minor scratches & dings (including windshield “dings” due to road gravel) which would be considered normal wear and tear for the environment. Vehicle interior is intact without rips or broken parts. Take photos before and after, if you are concerned.

  • Please inform us before taking the vehicle if you notice any abnormal conditions at pick-up. Our vehicles are well-maintained and ideally suited for this region. We strive to prevent any incidents by ensuring no one drives an inferior vehicle on the highway. Should the vehicle not meet your expectations upon arrival, please call us immediately to report any discrepancies. We may offer a substitute vehicle, subject to availability, which could incur an additional cost—this can be discussed. A refund is also a consideration. However, if no concerns are reported at pick-up and the vehicle is used for the day, it will be deemed that you have accepted the vehicle as is.

Jurisdiction and venue

  • This agreement is legal and binding between Parties as stated above.

  • The Parties each represent that they have authority to enter into the agreement in the event of any dispute over this agreement, this Car Rental Agreement will be interpreted by the laws of the State of Alaska, and any lawsuit or arbitration must be brought in the corresponding region of Southeast Alaska. If any portion of this agreement is found to be unenforceable by a court of competent jurisdiction, the remainder of the agreement would still have full force and effect.

Entire Agreement

  • This Car Rental Agreement is the complete accord between the Parties regarding the subject matter herein.

  • Modifications to this agreement are not valid unless made in writing and signed by company management. Drive About Car Rental management may authorize changes via company email under special circumstances.

  • The Renter is required to provide a copy of their Driver's License, proof of insurance, and indicate if they are using a credit card that provides the necessary collision coverage. If opting for a second driver on the reservation form, the Renter must supply both drivers' license details and proof of insurance at the time of reservation.

  • Following the reservation payment, a confirmation email will be sent with a link to the Rental Contract/Agreement, which must be completed within three days. (If this is not received- there is a typo, or it is in your spam folder) let us know so we can make the correction!

  • Renters should be ready to upload clear copies of the Driver's License and proof of insurance for themselves and one additional driver to the Contract-Agreement within three days of making the reservation.
